EU-US data protection agreement: The perennial issue of data transfer

Karlsruhe, May 21, 2024 – The third attempt by the US administration to grant EU citizens and EU residents adequate protection in the transatlantic transfer of their data also does not appear to stand up to critical legal scrutiny. We are talking about the EU-US data protection agreement negotiated by the European Commission, the EU-US Data Privacy Framework (DPF).

Prof. Dr. Franziska Boehm, in collaboration with one of the leading European think tanks, the Centre for European Policy Studies (CEPS) and Prof. Dr. Valsamis Mitsilegas (University of Liverpool), has written a detailed report on the legal assessment of the aforementioned regulations. According to the CEPS Task Force Report: "'Reconstitutionalizing Privacy - EU-US Data Transfers and Their Impact on The Rule of Law, Rights and Trust", the necessary EU standards for lawful transatlantic data transfers are once again not sufficiently met, in particular the principles of the General Data Protection Regulation (GDPR) and the EU Charter of Fundamental Rights are not complied with.
